    摘要:

    结构与能动是分析政治问题的一个重要的理论视角。传统意义上,人们一直以“人治”和“法治”来分别定义先秦儒、法两个学派的治理观念,而从结构与能动的视角来看,儒、法两家治理观念的对立在某种程度上是主观与客观、结构与能动的二元对立。法家以慎到为代表,表现出了过于重视结构、忽视个体的结构主义;孔子继承周代的人文传统,其“仁”的思想显示了对能动个体的重视,而其“礼”的思想也显示了其并未忽视结构因素,但儒家至思孟学派则发展为过于偏重能动的意图主义倾向。此后荀子构建“礼义之统”力图纠正儒学的这一偏向,但最终又落入儒家政治道德主义的窠臼。作为先秦法家集大成者的韩非,将“法术势”融为一体的权力观虽然显示了其在调和结构与能动方面的努力,但最终又沦为了一种深层的结构主义。要之,先秦儒、法治理观念的争论与发展,某种程度上正是围绕着结构与能动的关系问题而展开的。

    Abstract:

    Structure and agency are important theoretical perspectives in the analysis of political issues. In the traditional sense, people have been using “rule by man” and “rule by law” to define the governance concepts of the two schools of Confucianism and Legalism respectively, but from the perspective of structure and agency, the opposition of the two governance concepts of Confucianism and Legalism is, to some extent, the dual opposition of subjective and objective, structure and agency. The legalists, represented by Shen Dao, showed the structuralism that paid too much attention to the structure and neglected the individual. Confucius inherited the cultural tradition of Zhou dynasty, his thought of “Ren” shows the emphasis on active individuals, and his thought of “Li” also shows he did not ignore the structure factors, but Confucianism developed into the intentionalism tendency that placed too much emphasis on active factors in Simencius School. After that, Xunzi tried to correct the bias by constructing “the unification of Li and Yi”, but he eventually fell into the pattern of Confucian political moralism. Han Fei, a master of pre-Qin legalists, showed his efforts to reconcile structure and agency by integrating “Fa, Shu and Shi” into his view of power, but eventually he became a deep structuralism. To some extent, the debate and development of the concept of governance of Confucianism and Legalism in the pre-Qin period were centered on the relationship between structure and agency.
